The following terms and conditions serve as the legal agreement between the customer (hereafter referred to as “You” or “User”) and Edwina Brewster HR Consulting Ltd (hereafter referred to as “We,” “Us,” “Our,” or similar), a company that offers a wide range of HR services to help employers to meet their legal obligations, assist with management and development of their employees and ultimately contribute to the success of that business.

Users must read this agreement thoroughly before continuing to download or purchase products from the website, upon which you agree to the provisions stated in this agreement. If, however, you do not agree to any or all parts of this document, please discontinue the use of the website immediately.

GENERAL TERMS & CONDITIONS 

This agreement, known hereafter as the Terms and Conditions, is legally binding and enforceable. Users have been advised to read the contents of the agreement before proceeding with downloads. As a user, your use of our downloads or products will immediately indicate that you have read the terms and conditions and have therefore agreed upon the provisions stated herein. Any violations of the provisions stated in the agreement may hold you accountable for liabilities in court.

Except for Strengthscope products, all documents are written and produced by us and are compliant in the UK at the date of purchase. However, they are not intended as a substitute for professional, legal, or other advice with respect to specific circumstances. Users are advised to obtain additional advice before relying on any piece of information in circumstances where loss or damage may result.

We comply with the Data Protection Act 1998 and the General Data Protection Regulations and are aware of our responsibilities to process personal information in accordance with the eight principles of the Act; and to answer subject access requests received from individuals.

You should always check that the contact information you provide is correct before proceeding to payment.

We make every effort to ensure that the pricing displayed on our website is correct. However, if an error in the pricing of a product is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable).

NOTIFICATIONS AND EMAILS

Providing us with your email address consents to our use of such to send you service-related notices, such as those required by law, in lieu of communication via postal mail. Your email address may also be used to send you other messages such as changes to Service Features and/or special offers via our Newsletter. We are not responsible, however, for any automatic filtering that you or your network provider may apply to notifications sent to the email address provided to edwinabrewsterhr.co.uk. We may provide other notifications via email notice, or through posting of information on our website, as determined necessary.

IMAGERY, CLIPS, TYPEFACES

The distribution or usage of images, featured on the website or in downloads or products is prohibited, doing so will be considered a violation of the terms and conditions agreement.

VALIDITY OF PURCHASE

The documents and products purchased will be available for you to download for up to 7 days from the date of purchase. If you fail to download documents within 7 days of purchase, we will not be obliged to provide you with any refund or compensation for the same.

PRODUCT OWNERSHIP

Documents, templates, and other products available on the website remain the sole property of Edwina Brewster HR Consulting Ltd. Users are not permitted to re-sell any product purchased or downloaded from our site.

Any use of content without our permission shall be deemed an act of violation of Intellectual Property Rights of the company and is therefore prohibited.

PRODUCT MODIFICATIONS

Upon download of a product or document, you will be given the right to modify, alter, or change the template in any way as you see fit. However, the prerogative remains yours and we are not under obligation to do any redesign of the product for your benefit.

UNLAWFUL ACTIVITIES

We reserve the right to investigate complaints or reported violations of this Agreement. We also take it upon ourselves to take action as we deem appropriate, including but not limited to, reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties; disclosing any information necessary or appropriate to such persons or entities.

LINKING TO THIRD-PARTY SOURCES

Our website, products and downloads may contain links to other websites. We do not have any control or responsibility over anything posted on third-party sites, nor do we endorse or sponsor those sites, even those affiliated to us.

We reserve the right to insist that any link to our website be discontinued.

RETURN AND REFUND POLICIES

The products displayed on edwinabrewsterhr.co.uk are purchased on an “as is” basis. They are, therefore excluded, to the fullest extent permitted by the applicable laws (including The Consumer Protection Distance Selling Regulations 2000), from any warranty, expressed or implied, including any qualities for satisfaction or fitness. These products are not due for return or refund, except where non-delivery of a product has occurred. Such claims of non-delivery shall be submitted to us by email within seven (7) days from the purchase date, otherwise, the product is assumed to have been downloaded and received accordingly.

LIABILITY DISCLAIMER

Edwina Brewster HR Consulting Ltd is not liable for damages that may arise from your use, or inability to do so, of the products purchased. Including but not limited to, lost profits, direct or indirect damages, incidental, punitive or consequential damages.

The Terms and Conditions agreement shall be interpreted, construed, and governed by the appropriate laws, we have the right to commence any legal action before a competent court of jurisdiction to obtain an injunction or relief in any event appropriate for the company to do so. No action unless explicitly written, shall be construed as a waiver to the rights and privileges of Edwina Brewster HR Consulting Ltd. Any provision in this agreement deemed unenforceable by court shall not affect other valid provisions as outlined in the agreement.

We reserve the right to change, modify, amend, or terminate the Terms and Conditions, along with the sale of products and services, without prior notice.

The terms and conditions stated in the provisions of this agreement shall hereby be deemed enforceable, effective immediately.

The aggregate liability of Edwina Brewster HR Consulting Ltd, in connection with any claims arising out of, or relating to the site and/or its products, information, documents and services provided herein shall not exceed ÂŁ100 and that amount shall be in lieu of all other remedies which users may have against us.

These Terms & Conditions shall be interpreted, construed, and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.

Your statutory rights are unaffected.
